Article R744-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Administrative detention centres are set up, on the proposal of the minister responsible for immigration, by joint order of the minister responsible for social affairs, the minister responsible for immigration, the minister of the interior and the minister of justice.
This order specifies the address of the centre and whether its surveillance is entrusted to the national police or the national gendarmerie and whether the centre is likely to accommodate families.
It also specifies whether the centre can accommodate a foreign national whose detention is extended pursuant to the provisions of articles L. 742-5, L. 742-6 or L. 742-7.

Article R744-3

Les centres de rétention administrative sont créés, sur proposition du ministre chargé de l’immigration, par arrêté conjoint du ministre chargé des affaires sociales, du ministre chargé de l’immigration, du ministre de l’intérieur et du ministre de la justice.
Cet arrêté mentionne l’adresse du centre et précise, d’une part, si sa surveillance en est confiée à la police nationale ou à la gendarmerie nationale et, d’autre part, si ce centre est susceptible d’accueillir des familles.
Il précise, en outre, si le centre peut accueillir un étranger dont la rétention est prolongée en application des dispositions des articles L. 742-5, L. 742-6 ou L. 742-7.
