Article R752-10 of the French Commercial code

If the application for authorisation to operate a business within the meaning of articles R. 752-4 to R. 752-6 is complete, the commission secretariat shall inform the mayor. In the absence of any information to the contrary communicated to the mayor by the commission secretariat within fifteen clear days of receipt of the application, the application is deemed to be complete. This period runs from the day on which the application for authorisation to operate a business is received at the secretariat of the departmental commission.

If the commercial authorisation application file is incomplete, the commission secretariat will inform the mayor of the missing documents that must be included in the file. Within three days of receipt, the mayor forwards the missing documents to the commission secretariat.

The time limit for examining the application for authorisation to operate a business is counted from receipt of a complete file by the secretariat of the departmental commercial development commission. As soon as this application is received, the Prefect, in accordance with article L. 751-2, inform, by any means, the mayors of the communes bordering the commune of establishment included in the trading area as mentioned and defined in Articles L. 751-2 and R. 752-3.

Si le dossier de demande d’autorisation d’exploitation commerciale au sens des articles R. 752-4 à R. 752-6 est complet, le secrétariat de la commission en informe le maire. A défaut d’information contraire communiquée au maire par le secrétariat de la commission dans le délai de quinze jours francs suivant la réception du dossier, le dossier est réputé complet. Ce délai court à compter du jour de réception au secrétariat de la commission départementale de la demande d’autorisation d’exploitation commerciale.

Si le dossier de demande d’autorisation d’exploitation commerciale est incomplet, le secrétariat de la commission informe le maire des pièces manquantes qui doivent figurer dans ce dossier. Dans les trois jours suivant leur réception, le maire transmet les pièces manquantes au secrétariat de la commission.

Le délai d’instruction de la demande d’autorisation d’exploitation commerciale court à compter de la réception par le secrétariat de la commission départementale d’aménagement commercial d’un dossier complet. Dès cette réception le préfet, en application du I de l’article L. 751-2, informe, par tout moyen, les maires des communes limitrophes de la commune d’implantation incluses dans la zone de chalandise telle que mentionnée et définie aux articles L. 751-2 et R. 752-3.
