Article R752-21 of the French Commercial code

The procedure provided for in article L. 752-4 is applicable to any planning permission application relating to a project for the creation or extension of a building in a commune with a population of less than 20,000 and, where the project results in the artificial creation of land, within the meaning of the ninth paragraph of Article L. 101-2-1 of the town planning code, in relation to the state of the parcels concerned on 23 August 2021, in all communes, of a retail shop or a commercial complex whose overall sales area, if the project were carried out, would be between 300 and 1,000 square metres.

Article R. 751-3 is not applicable to the procedure provided for in Article L. 752-4.

Article R752-21

La procédure prévue à l’article L. 752-4 est applicable à toute demande de permis de construire relative à un projet de création ou d’extension, dans une commune de moins de 20 000 habitants et, lorsque le projet engendre une artificialisation des sols, au sens du neuvième alinéa de l’article L. 101-2-1 du code de l’urbanisme, par rapport à l’état des parcelles concernées au 23 août 2021, dans toutes les communes, d’un magasin de commerce de détail ou d’un ensemble commercial dont la surface de vente globale, en cas de réalisation du projet, serait comprise entre 300 et 1 000 mètres carrés.

L’article R. 751-3 n’est pas applicable à la procédure prévue à l’article L. 752-4.
