Article R752-29-2 of the French Commercial code

Within fifteen clear days of the registration of an application for authorisation to operate a business at the secretariat of the departmental commission for a project mentioned in the first or second paragraph of article L. 752-1-2, the Prefect of the département in which the project is located may request, in the event that the authorisation procedure is suspended:

a) For projects mentioned in the first paragraph of article L. 752-1-2, the opinion of the president of the local authority of the municipality in which the project is located and the opinion of each of the mayors of the municipalities that are signatories to the territorial regeneration operation agreement;

b) For the projects mentioned in the second paragraph of article L. 752-1-2, the opinion of the president of the public establishment for inter-municipal cooperation with its own tax system that is a signatory to the agreement for the revitalisation of the area, each of the mayors of the municipalities that are signatories to this same agreement, the mayor of the municipality in which the project is located and, if the latter is a member of a public establishment for inter-municipal cooperation with its own tax system that borders the public establishment for inter-municipal cooperation that is a signatory, the opinion of its president.

The prefect’s request for an opinion includes:

a) For the projects mentioned in the first paragraph of article L. 752-1-2, a statement of the characteristics of the project and the data specific to the sectors of intervention defined in the agreement included in the trading zone, such as to justify suspension of the procedure before the departmental commission;

b) For the projects mentioned in the second paragraph of article L. 752-1-2, a statement of the characteristics of the project and the objectives pursued by the revitalisation operation likely to be seriously compromised by the project, such as to justify suspension of the procedure before the departmental committee.

The sending of the request for an opinion gives rise to a fifteen-day response period, at the end of which the Prefect has seven days to issue a suspension order, if necessary. If the requests for an opinion are not sent on the same day, the period allowed for the Prefect to issue a suspension order, if applicable, runs from the expiry of the latest response period.

Dans le délai de quinze jours franc à compter de l’enregistrement d’une demande d’autorisation d’exploitation commerciale au secrétariat de la commission départementale pour un projet mentionné au premier ou au deuxième alinéa de l’article L. 752-1-2, le préfet du département d’implantation du projet peut solliciter, dans l’éventualité de la suspension de la procédure d’autorisation :

a) Pour les projets mentionnés au premier alinéa de l’article L. 752-1-2, l’avis du président de l’établissement public de coopération intercommunale à fiscalité propre dont est membre la commune d’implantation du projet et l’avis de chacun des maires des communes signataires de la convention d’opération de revitalisation de territoire ;

b) Pour les projets mentionnés au deuxième alinéa de l’article L. 752-1-2, l’avis du président de l’établissement public de coopération intercommunale à fiscalité propre signataire de la convention d’opération de revitalisation de territoire, de chacun des maires des communes signataires de cette même convention, du maire de la commune d’implantation du projet et, si celle-ci est membre d’un établissement public de coopération intercommunale à fiscalité propre limitrophe de l’établissement public de coopération intercommunale signataire, l’avis de son président.

La demande d’avis du préfet comporte :

a) Pour les projets mentionnés au premier alinéa de l’article L. 752-1-2, un exposé des caractéristiques du projet et des données propres aux secteurs d’intervention définis dans la convention inclus dans la zone de chalandise, de nature à justifier la suspension de la procédure devant la commission départementale ;

b) Pour les projets mentionnés au deuxième alinéa de l’article L. 752-1-2, un exposé des caractéristiques du projet et des objectifs poursuivis par l’opération de revitalisation susceptibles d’être gravement compromis par le projet, de nature à justifier la suspension de la procédure devant la commission départementale.

L’envoi de la demande d’avis fait courir un délai de réponse de quinze jours, au terme duquel le préfet a sept jours pour prendre, le cas échéant, un arrêté de suspension. Si les demandes d’avis ne sont pas envoyées le même jour, le délai imparti au préfet pour prendre, le cas échéant, un arrêté de suspension court à l’expiration du délai de réponse le plus tardif.
