Article R752-30 of the French Commercial code

The time limit for appealing against a decision or opinion of the departmental commission is one month. It runs:

1° For the applicant, from notification of the decision or opinion;

2° For the prefect and the members of the departmental commission, from the commission meeting or, in the case of a tacit decision or opinion, from the date on which authorisation is deemed to have been granted;

3° For any other person mentioned in article L. 752-17, from the latest of the publicity measures provided for in the third and fifth paragraphs of article R. 752-19.

Compliance with the time limit for appeal is assessed on the date the appeal is sent.

Article R752-30

Le délai de recours contre une décision ou un avis de la commission départementale est d’un mois. Il court :

1° Pour le demandeur, à compter de la notification de la décision ou de l’avis ;

2° Pour le préfet et les membres de la commission départementale, à compter de la réunion de la commission ou, en cas de décision ou d’avis tacite, à compter de la date à laquelle l’autorisation est réputée accordée ;

3° Pour toute autre personne mentionnée à l’article L. 752-17, à compter de la plus tardive des mesures de publicité prévues aux troisième et cinquième alinéas de l’article R. 752-19.

Le respect du délai de recours est apprécié à la date d’envoi du recours.
