Article R752-31 of the French Commercial code

The appeal shall be submitted to the chairman of the Commission nationale d’aménagement commercial by any secure means or, where it is submitted by the prefect, by ordinary administrative channels.

On pain of inadmissibility, the appeal shall state the grounds on which it is based and be accompanied by proof of the capacity and interest giving cause to act of each appellant.

Where the appeal is submitted by several persons, the authors shall elect domicile in a single place. Failing this, notifications, summonses or other documents are validly addressed to the domicile of the first signatory.

An opinion issued on the basis of article L. 752-4 may only be appealed in the event of an unfavourable opinion. Such an appeal may only be lodged by the applicant.

Le recours est présenté au président de la Commission nationale d’aménagement commercial par tout moyen sécurisé ou, lorsqu’il est présenté par le préfet, par la voie administrative ordinaire.

A peine d’irrecevabilité, le recours est motivé et accompagné de la justification de la qualité et de l’intérêt donnant pour agir de chaque requérant.

Lorsque le recours est présenté par plusieurs personnes, ses auteurs élisent domicile en un seul lieu. A défaut, les notifications, convocations ou autres actes sont valablement adressés au domicile du premier signataire.

Un avis rendu sur le fondement de l’article L. 752-4 ne peut faire l’objet d’un recours qu’en cas d’avis défavorable. Un tel recours ne peut être présenté que par le demandeur.
