Article R752-4 of the French Commercial code

The application for authorisation to operate a business shall be submitted:

a) Either by the owner or owners of the land or buildings, by any person proving title from the owner or owners entitling him to carry out the work or by the agent of one of these persons;

b) Or by a person entitled to benefit from expropriation for reasons of public utility;

In cases where a building permit is not required, the application for authorisation to operate commercially may also be submitted by any person providing proof of a title from the owner(s) entitling him/her to commercially operate the buildings or by the agent of such a person.

La demande d’autorisation d’exploitation commerciale est présentée :

a) Soit par le ou les propriétaires du ou des terrains ou immeubles, par toute personne justifiant d’un titre du ou des propriétaires l’habilitant à exécuter les travaux ou par le mandataire d’une de ces personnes ;

b) Soit par une personne ayant qualité pour bénéficier de l’expropriation pour cause d’utilité publique ;

Dans le cas où un permis de construire n’est pas nécessaire, la demande d’autorisation d’exploitation commerciale peut également être présentée par toute personne justifiant d’un titre du ou des propriétaires l’habilitant à exploiter commercialement les immeubles ou par le mandataire de cette personne.
