Article R752-44-14 of the French Commercial code

Where the commercial development falls under article L. 752-1-1, the project owner must publish a notice of the opening to the public in two regional or local newspapers circulated in the département, at least one month before the planned opening date. The project promoter is defined as the owner of the land or building or, where applicable, any person authorised by the owner to build or commercially operate the facility.

The commercial facility is described, with the exact address where it is to be located. Article L. 752-1-1 of the French Commercial Code and the applicable territorial revitalisation operation agreement, defined in article L. 303-2 of the French Construction and Housing Code.

The project developer must provide the Prefect with a copy of these two publications prior to opening to the public.

If the facility comprises several shops, the time limits for publication and communication of the notice(s) of opening to the public are assessed on a shop-by-shop basis.

Lorsque l’équipement commercial relève de l’article L. 752-1-1, le porteur de projet fait publier, dans deux journaux régionaux ou locaux diffusés dans le département, un avis d’ouverture au public au plus tard un mois avant la date d’ouverture prévue. Le porteur de projet s’entend du propriétaire du terrain ou de l’immeuble ou, le cas échéant, de toute personne habilitée par le propriétaire à construire ou exploiter commercialement cet équipement.

L’équipement commercial y est décrit, avec mention de son adresse exacte d’implantation. L’article L. 752-1-1 du code de commerce et la convention d’opération de revitalisation de territoire applicable, définie à l’article L. 303-2 du code de la construction et de l’habitation, y sont mentionnés.

Le porteur de projet communique au préfet une copie de ces deux publications préalablement à l’ouverture au public.

Si l’équipement comporte plusieurs commerces, les délais de publication et de communication du ou des avis d’ouverture au public s’apprécient commerce par commerce.
