Article R752-44-18 of the French Commercial code

For the application of the provisions of article L. 752-5-1 and of II of article L. 752-23, the Prefect may appoint officials authorised for this purpose by the Minister for the Economy to carry out inspections.

Where an infringement of articles L. 752-1 and L. 752-23 and the texts implementing them is observed, the operator concerned is informed, with the responsibility, where applicable, of informing the holder of the commercial authorisation. The operator will be asked to provide an explanation within fifteen clear days, and failure to do so will be deemed to constitute acquiescence in the finding of an infringement.

If, on expiry of this period, the aforementioned officers maintain their finding, they send a report noting the infringements to the Prefect, who implements, if necessary, the measures provided for in II of article L. 752-23.

Pour l’application des dispositions de l’article L. 752-5-1 et du II de l’article L. 752-23, le préfet peut mandater des fonctionnaires habilités à cet effet par le ministre chargé de l’économie pour réaliser des contrôles.


Lorsqu’une infraction aux articles L. 752-1 et L. 752-23 et aux textes pris pour leur application est constatée, l’exploitant concerné en est informé, à charge pour lui, le cas échéant, d’informer le titulaire de l’autorisation d’exploitation commerciale. Il est invité à s’expliquer sous quinze jours francs, son silence valant acquiescement au constat d’infraction.


Si, à l’expiration de ce délai, les agents susmentionnés maintiennent leur constat, ils transmettent un rapport relevant les infractions au préfet, qui met en œuvre, s’il y a lieu, les mesures prévues au II de l’article L. 752-23.
