Article R752-48 of the French Commercial code

In the event of failure to comply with the requirements of articles R. 752-45 and R. 752-46, the Prefect will ask the owner of the site to provide explanations of the planned measures and the timetable for operations within two months.

After this deadline, and in the absence of sufficient justification, the prefect will give formal notice to the owner of the site to dismantle and restore the site within a specified timeframe.

He will inform the competent planning permission authority of this.

Article R752-48

En cas de non-respect des prescriptions des articles R. 752-45 et R. 752-46, le préfet demande au propriétaire du site d’implantation de lui fournir sous deux mois des explications quant aux mesures prévues et au calendrier des opérations.

Passé ce délai et en l’absence de justifications suffisantes, il met en demeure le propriétaire du site d’implantation de procéder aux opérations de démantèlement et de remise en état dans un délai qu’il fixe.

Il en informe l’autorité compétente en matière de permis de construire.
