Article R753-1 of the French Monetary and Financial Code

I. – Subject to the adaptations provided for in II and III, the provisions of the articles mentioned in the left-hand column of the table below shall apply in French Polynesia, in the wording indicated in the right-hand column of the same table:

II. – For the application of I:
1° In article R. 312-4-3:
a) In 2° of B of I, the words: “pursuant to article L. 722-1 of the French Consumer Code, as well as those benefiting from measures to deal with their overindebtedness, for the duration of their registration in the file provided for in article L. 751-1 of the French Consumer Code” are replaced by the words: “and those benefiting from measures to deal with their situation of overindebtedness, for the duration of their registration in the national file recording information on serious payment incidents provided for in article L. 771-7 of the French Consumer Code”;
b) 4° of III is replaced by the following:
“4° Four monthly local or SEPA-COM-Pacific credit transfers, including at least one standing order, and an unlimited number of local or SEPA-COM-Pacific direct debits”;
c) In IV, the words “INSEE consumer price index” are replaced by the words “locally calculated consumer price index”.
2° In article R. 312-4-4:
a) All occurrences of the words: “ten days” are replaced by the words: “twenty days”;
b) The words: “twenty days” are replaced by the words: “forty days”;
c) The words: “five days” are replaced by the words: “ten days”;
3° In articles R. 312-7 and R. 312-8-1, each occurrence of the words: “the Banque de France” is replaced by the words: “the Institut d’émission d’outre-mer”.
III. – Articles R. 312-1-2 and R. 312-4-1 to R. 312-8-1 are applicable to the Office des postes et télécommunications.

Article R753-1

I. – Sont applicables en Polynésie française, sous réserve des adaptations prévues au II et au III, les dispositions des articles mentionnés dans la colonne de gauche du tableau ci-après, dans leur rédaction indiquée dans la colonne de droite du même tableau :

II. – Pour l’application du I :
1° A l’article R. 312-4-3 :
a) Au 2° du B du I, les mots : « en application de l’article L. 722-1 du code de la consommation ainsi que ceux qui bénéficient de mesures de traitement de leur situation de surendettement, pendant la durée de leur inscription au fichier prévu à l’article L. 751-1 du code de la consommation » sont remplacés par les mots : « et ceux qui bénéficient de mesures de traitement de leur situation de surendettement, pendant la durée de l’inscription au fichier national recensant les informations sur les incidents de paiement caractérisés prévue à l’article L. 771-7 du code de la consommation » ;
b) Le 4° du III est remplacé par les dispositions suivantes :
« 4° Quatre virements mensuels locaux ou SEPA-COM-Pacifique, dont au moins un virement permanent, ainsi que des prélèvements locaux ou SEPA-COM-Pacifique en nombre illimité » ;
c) Au IV, les mots : « indice INSEE des prix à la consommation » sont remplacés par les mots : « indice des prix à la consommation calculé localement, ».
2° A l’article R. 312-4-4 :
a) Toutes les occurrences des mots : « dix jours » sont remplacés par les mots : « vingt jours » ;
b) Les mots : « vingt jours » sont remplacés par les mots : « quarante jours » ;
c) Les mots : « cinq jours » sont remplacés par les mots : « dix jours » ;
3° Aux articles R. 312-7 et R. 312-8-1, chaque occurrence des mots : « la Banque de France » est remplacée par les mots : « l’Institut d’émission d’outre-mer ».
III. – Les articles R. 312-1-2 et R. 312-4-1 à R. 312-8-1 sont applicables à l’Office des postes et télécommunications.
