Article R761-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book in Guadeloupe, French Guiana, Martinique and Reunion:
1° References to the departmental prefect are replaced by references to the State representative;
2° Article R. 711-1 reads as follows:

“Art. R. 711-1.-The decision imposing an obligation to leave French territory is deemed to have been executed on the date on which the administration’s stamp has been affixed to the travel documents of the foreign national who is subject to it, when leaving national territory bound for any country, other than a Member State of the European Union, the Republic of Iceland, the Principality of Liechtenstein, the Kingdom of Norway or the Swiss Confederation. “;

3° Articles R. 751-1 to R. 751-9 do not apply;
4° The last paragraph of Article R. 752-5 and the last paragraph of Article R. 753-4 do not apply;
5° In Article R. 753-5, after the words: “to the rules defined in Chapter VII quater of Title VII of Book VII of the Code of Administrative Justice”, the following words are added: “and subject to the adaptations provided for in Title VIII of Book VII of the same Code”;
6° Article R. 754-1 is not applicable;
7° In Article R. 754-8, after the words: “to the rules defined in Chapter VII bis of Title VII of Book VII of the Code of Administrative Justice”, the words: “and subject to the adaptations provided for in Title VIII of Book VII of the same code” are added.

Article R761-2

Pour l’application du présent livre en Guadeloupe, en Guyane, en Martinique et à La Réunion :
1° Les références au préfet de département sont remplacées par la référence au représentant de l’Etat ;
2° L’article R. 711-1 est ainsi rédigé :

” Art. R. 711-1.-La décision portant obligation de quitter le territoire français est réputée exécutée à la date à laquelle le cachet de l’administration a été apposé sur les documents de voyage de l’étranger qui en fait l’objet, lors de sa sortie du territoire national à destination de tout pays, autre qu’un Etat membre de l’Union européenne, la République d’Islande, la Principauté du Liechtenstein, le Royaume de Norvège ou la Confédération suisse. ” ;

3° Les articles R. 751-1 à R. 751-9 ne sont pas applicables ;
4° Le dernier alinéa de l’article R. 752-5 et le dernier alinéa de l’article R. 753-4 ne sont pas applicables ;
5° A l’article R. 753-5, après les mots : ” aux règles définies au chapitre VII quater du titre VII du livre VII du code de justice administrative “, sont ajoutés les mots : ” et sous réserve des adaptations prévues au titre VIII du livre VII du même code ” ;
6° L’article R. 754-1 n’est pas applicable ;
