Article R*761-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The competent administrative authority in the cases provided for in 1° of article R.* 732-3 is the State representative.
However, the competent administrative authority in these cases is the Minister of the Interior when, at the time the house arrest is issued, the foreign national is in a department of mainland France, Saint-Barthélemy, Saint-Martin or Saint-Pierre-et-Miquelon.

Article R*761-3

L’autorité administrative compétente dans les cas prévus au 1° de l’article R.* 732-3 est le représentant de l’Etat.
Toutefois, l’autorité administrative compétente dans ces cas est le ministre de l’intérieur lorsqu’au moment du prononcé de l’assignation à résidence, l’étranger se trouve dans un département de la France métropolitaine, à Saint-Barthélemy, à Saint-Martin ou à Saint-Pierre-et-Miquelon.
