Article R762-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book to Saint-Barthélemy:
1° References to the Prefect are replaced by the reference to the Representative of the State in Saint-Barthélemy;
2° Article R. 711-1 is worded as follows:

“Art. R. 711-1.-The decision imposing an obligation to leave French territory is deemed to have been executed on the date on which the administration’s stamp was affixed to the travel documents of the foreign national who is the subject of it, when leaving national territory to any country, other than a Member State of the European Union, the Republic of Iceland, the Principality of Liechtenstein, the Kingdom of Norway or the Swiss Confederation. “3° In article R. 722-1, the words: “by Council Decision 2004/191/EC of 23 February 2004 setting out the criteria and practical arrangements for the compensation of the financial imbalances resulting from the application of Directive 2001/40/EC on the mutual recognition of decisions on the expulsion of third-country nationals” are replaced by the words: “by the international conventions and regulations in force”;
4° In article R. 732-6, after the words: “work permit”, the following words are added: “in accordance with locally applicable legislation and regulations”;
5° The last paragraph of article R. 752-5 and the last paragraph of article R. 753-4 are not applicable;
6° In article R. 753-5, after the words: “to the rules defined in Chapter VII quater of Title VII of Book VII of the Code of Administrative Justice”, the words: “and subject to the adaptations provided for in Title VIII of Book VII of the same Code” are added;
7° In article R. 754-8, after the words: “to the rules defined in Chapter VII bis of Title VII of Book VII of the Code of Administrative Justice”, the words “and subject to the adaptations provided for in Title VIII of Book VII of the same code” are added.

Article R762-3

Pour l’application du présent livre à Saint-Barthélemy :
1° Les références au préfet sont remplacées par la référence au représentant de l’Etat à Saint-Barthélemy ;
2° L’article R. 711-1 est ainsi rédigé :

” Art. R. 711-1.-La décision portant obligation de quitter le territoire français est réputée exécutée à la date à laquelle le cachet de l’administration a été apposé sur les documents de voyage de l’étranger qui en fait l’objet, lors de sa sortie du territoire national à destination de tout pays, autre qu’un Etat membre de l’Union européenne, la République d’Islande, la Principauté du Liechtenstein, le Royaume de Norvège ou la Confédération suisse. ” ;

3° A l’article R. 722-1, les mots : ” par la décision du Conseil n° 2004/191/ CE du 23 février 2004 définissant les critères et modalités pratiques de la compensation des déséquilibres financiers résultant de l’application de la directive 2001/40/ CE relative à la reconnaissance mutuelle des décisions d’éloignement des ressortissants de pays tiers ” sont remplacés par les mots : ” par les conventions internationales et les règlements en vigueur ” ;
4° A l’article R. 732-6, après les mots : ” autorisation de travail “, sont ajoutés les mots : ” selon la législation et la réglementation applicables localement ” ;
5° Le dernier alinéa de l’article R. 752-5 et le dernier alinéa de l’article R. 753-4 ne sont pas applicables ;
6° A l’article R. 753-5, après les mots : ” aux règles définies au chapitre VII quater du titre VII du livre VII du code de justice administrative “, sont ajoutés les mots : ” et sous réserve des adaptations prévues au titre VIII du livre VII du même code ” ;
7° A l’article R. 754-8, après les mots : ” aux règles définies au chapitre VII bis du titre VII du livre VII du code de justice administrative “, sont ajoutés les mots : ” et sous réserve des adaptations prévues au titre VIII du livre VII du même code “.
