Article R773-1 of the French Monetary and Financial Code

I. -Subject to the adaptations provided for in II, the provisions of the articles mentioned in the left-hand column of the table below shall apply in New Caledonia, in the wording indicated in the right-hand column of the same table:

II. – For the application of I:
1° In 1° of II of Article R. 511-2-1-1, after the words: “mentioned in Article L. 714-1 of the Intellectual Property Code” are added the words: “in the version applicable in New Caledonia”;
2° In b of 3° of Article R. 511-2-1-2:
a) The words: “as defined in Article 3 of Decree No. 2008-1354 of 18 December 2008 on the criteria for determining the category to which a company belongs for the purposes of statistical and economic analysis;” are replaced by the words: “as defined below:”;
b) The following paragraphs are added:

“a small or medium-sized enterprise is an enterprise which employs fewer than 250 people and whose annual turnover does not exceed CFP 5,966,500,000 or whose annual balance sheet total does not exceed CFP 5,131,190,000;
“an intermediate-sized company is one which employs between 250 and 5,000 people and has an annual turnover of between 5,966,500,000 and 178,997,600,000 CFP francs or a balance sheet total of between 5,131,190,000 and 238,663,490,000 CFP francs;
a large company is one which employs more than 5,000 people and has a turnover in excess of 178,997,600,000 CFP francs or a balance sheet total in excess of 238,663,490,000 CFP francs. ” ;

3° In Article R. 511-2-2, the words: “or R. 511-3-1” are deleted;
4° In the second paragraph of I of Article R. 511-16, the words: “referred to in Commission Regulation (EC) No 1126/2008 of 3 November 2008 are deleted.

II. – Pour l’application du I :
1° Au 1° du II de l’article R. 511-2-1-1, après les mots : « mentionnée à l’article L. 714-1 du code de la propriété intellectuelle » sont ajoutés les mots : « dans leur version applicable en Nouvelle-Calédonie » ;
2° Au b du 3° de l’article R. 511-2-1-2 :
a) Les mots : « selon les définitions de l’article 3 du décret n° 2008-1354 du 18 décembre 2008 relatif aux critères permettant de déterminer la catégorie d’appartenance d’une entreprise pour les besoins de l’analyse statistique et économique ; » sont remplacés par les mots : « ainsi définies : » ;
b) Sont ajoutés les alinéas suivants :

« – une petite ou moyenne entreprise est une entreprise qui occupe moins de 250 personnes et dont le chiffre d’affaires annuel n’excède pas 5 966 500 000 CFP ou dont le total du bilan annuel n’excède pas 5 131 190 000 francs CFP ;
« – une entreprise de taille intermédiaire est une entreprise qui occupe entre 250 et 5 000 personnes et a un chiffre d’affaires annuel entre 5 966 500 000 et 178 997 600 000 francs CFP ou un total de bilan entre 5 131 190 000 et 238 663 490 000 francs CFP ;
« – une grande entreprise est une entreprise qui occupe plus de 5 000 personnes et a un chiffre d’affaires supérieur à 178 997 600 000 francs CFP ou un total de bilan supérieur à 238 663 490 000 francs CFP. » ;

3° A l’article R. 511-2-2, les mots : « ou R. 511-3-1 » sont supprimés ;
4° Au second alinéa du I de l’article R. 511-16, les mots : « mentionnée par le règlement (CE) n° 1126/2008 de la Commission du 3 novembre 2008 sont supprimés.
