Article R8211-2 of the French Labour Code

When a natural or legal person is convicted by a criminal judgment for one of the offences of illegal employment mentioned in Articles L. 8224-1, L. 8224-2, L. 8224-5, L. 8234-1, L. 8234-2, L. 8243-1, L. 8256-2 and L. 8256-7 to an additional penalty of publication of the criminal decision on the dedicated section of the Ministry’s website, the court registry will forward the decision to the central administration of the Ministry of Employment as soon as it has become final under the conditions set out inarticle 708 of the Code of Criminal Procedure, and without prejudice to the provisions of articles 471 and 512 of the same code.

Transmission, which may be dematerialised, is carried out under conditions that guarantee the integrity and confidentiality of the data transmitted.

The court registry informs the convicted person of the transmission of the criminal decision to the ministry responsible for employment with a view to publication on the dedicated section of the ministry’s website.

Lorsqu’une personne physique ou morale est condamnée par une décision pénale pour l’une des infractions de travail illégal mentionnées aux articles L. 8224-1, L. 8224-2, L. 8224-5, L. 8234-1, L. 8234-2, L. 8243-1, L. 8256-2 et L. 8256-7 à une peine complémentaire de diffusion de la décision pénale sur la partie dédiée du site internet du ministère, le greffe de la juridiction transmet la décision aux services de l’administration centrale du ministère chargé du travail dès qu’elle a acquis un caractère définitif dans les conditions prévues par l’article 708 du code de procédure pénale, et sans préjudice des dispositions des articles 471 et 512 du même code.

La transmission, qui peut être dématérialisée, est assurée dans des conditions garantissant l’intégrité et la confidentialité des données transmises.

Le greffe informe la personne condamnée de la transmission de la décision pénale au ministère chargé du travail en vue d’une publication sur la partie dédiée du site internet de ce ministère.
