Article R822-1 of the French Code governing the entry and residence of foreign nationals and the right of asylum

If a foreign national subject to the obligation to guarantee repatriation is no longer able to produce the transport ticket or bank certificate referred to in article R. 313-5, the offence will be punishable by the penalties laid down for fifth-class offences.

The penalties laid down for fifth-class offences will be punishable by the penalties laid down for fifth-class offences if the foreign national is no longer able to produce the transport ticket or bank certificate referred to in article R. 313-5.

Est puni des peines prévues pour les contraventions de cinquième classe le fait, pour un étranger soumis à l’obligation de garantir son rapatriement, de ne plus être en mesure de produire le titre de transport ou l’attestation bancaire mentionnés à l’article R. 313-5.
