Article R8293-1 of the French Labour Code

I.-When an employee is hired, the employer referred to in the first and fourth paragraphs of article R. 8291-1 submits a declaration to the union of funds referred to in article R. 8291-2, in order to obtain a professional identification card.

The declaration is accompanied by the information mentioned in 1° of article R. 8292-1, 1° and 5° of article R. 8292-2, and 1° and 2° of article R. 8295-2 and the employee’s passport photograph.

This declaration is made by electronic means on a dedicated website of the union of funds mentioned in article R. 8291-2.

II -For temporary employees who do not have a valid card at the start of the assignment, the temporary employment agency sends a declaration to the union of funds mentioned in Article R. 8291-2, in order to obtain a professional identification card.

The declaration is accompanied by the information mentioned in 1° of article R. 8292-1, 2° of article R. 8292-2 and article R. 8295-2 and an identity photograph of the employee.

This declaration is made by electronic means on a dedicated website of the union of funds mentioned in Article R. 8291-2.

III – Before making the declaration, the employer informs the employee of the transmission of personal data concerning him/her to the union of funds mentioned in Article R. 8291-2.

Article R8293-1

I.-Lors de l’embauche d’un salarié, l’employeur mentionné au premier et au quatrième alinéa de l’article R. 8291-1 adresse une déclaration auprès de l’union des caisses mentionnée à l’article R. 8291-2, afin d’obtenir une carte d’identification professionnelle.

La déclaration est accompagnée des renseignements mentionnés au 1° de l’article R. 8292-1, au 1° et 5° de l’article R. 8292-2, et au 1° et au 2° de l’article R. 8295-2 et de la photographie d’identité du salarié.

Cette déclaration est effectuée par voie dématérialisée sur un site internet dédié de l’union des caisses mentionnée à l’article R. 8291-2.

II.-Pour les salariés intérimaires ne disposant pas d’une carte en cours de validité au début de la mission, l’entreprise de travail temporaire adresse une déclaration auprès de l’union des caisses mentionnée à l’article R. 8291-2, afin d’obtenir une carte d’identification professionnelle.

La déclaration est accompagnée des renseignements mentionnés au 1° de l’article R. 8292-1, au 2° de l’article R. 8292-2 et à l’article R. 8295-2 et de la photographie d’identité du salarié.

Cette déclaration est effectuée par voie dématérialisée sur un site internet dédié de l’union des caisses mentionnée à l’article R. 8291-2.

III.-Avant d’effectuer la déclaration, l’employeur informe le salarié de la transmission des données à caractère personnel le concernant à l’union des caisses mentionnée à l’article R. 8291-2.
