Article R930-1 of the French Commercial code

Subject to the adaptations provided for in the following chapters, the following provisions of the Code are applicable in New Caledonia:

1° Book I, with the exception of Articles R. 121-3, R. 121-4, R. 122-1 to R. 122-17, R. 123-171-1, R. 123-209 to R. 123-219, D. 123-235, D. 123-236, R. 127-1 to R. 134-17, R. 143-23, R. 145-9 to D. 145-19, R. 145-22 to D. 146-2. Articles R. 123-220 to R. 123-234-2 are applicable only insofar as they concern State institutions and departments and legal entities governed by administrative public law whose registered office is located in New Caledonia, as well as their establishments. Articles R. 123-220, R. 123-220-1, R. 123-221, R. 123-222, R. 123-222-1, R. 123-222-2, R. 123-223, R. 123-231, R. 123-232, R. 123-232-1, R. 123-233, R. 123-234, R. 123-234-1 and R. 123-234-2 are applicable in the version resulting from decree no. 2022-1014 of 19 July 2022;

2° Book II, with the exception of articles R. 229-1 à R. 229-26 et R. 252-1. Article D. 223-2 is applicable in its wording in force the day after the publication of decree no. 2008-1419 of 19 December 2008. Articles R. 223-20-1, R. 223-24, R. 225-98 and R. 227-1 shall apply in the wording in force on the day following the publication of the decree no. 2009-234 of 25 February 2009;

3° Book III, with the exception of Articles R. 310-1 à R. 310-19, R. 321-1 to R. 321-73 ;

4° Title V of Book IV, with the exception of Article D. 450-3 ;

5° Book V, with the exception of articles R. 522-1 to R. 522-25 ;

6° Book VI, with the exception of Articles R. 600-1, R. 600-2, R. 600-4 to R. 611-50, R. 621-1 à R. 663-40, R. 663-42 to R. 663-44, the first two paragraphs of article R. 663-45, articles R. 663-47, R. 663-48 and R. 670-1 to R. 670-7 ;

7° Title II of Book VII as amended by Decree no. 2021-144 of 11 February 2021, with the exception of Articles R. 721-7 à R. 722-6, R. 722-8, R. 722-9, R. 722-11 to R. 722-17, R. 723-4, R. 723-9 to R. 723-31;

8° Title II of Book VIII, with the exception of articles R. 822-149 to R. 822-162, in the version in force the day after the publication of decree no. 2013-192 of 5 March 2013. Article R. 823-7-1 is applicable in the version in force the day after the publication of Decree no. 2009-234 of 25 February 2009.

Sous réserve des adaptations prévues dans les chapitres ci-après, les dispositions suivantes du code sont applicables en Nouvelle-Calédonie :

1° Le livre Ier, à l’exception des articles R. 121-3, R. 121-4, R. 122-1 à R. 122-17, R. 123-171-1, R. 123-209 à R. 123-219, D. 123-235, D. 123-236, R. 127-1 à R. 134-17, R. 143-23, R. 145-9 à D. 145-19, R. 145-22 à D. 146-2. Les articles R. 123-220 à R. 123-234-2 ne sont applicables qu’en ce qu’ils concernent les institutions et services de l’Etat et les personnes morales de droit public administratif dont le siège est situé en Nouvelle-Calédonie, ainsi que leurs établissements. Les articles R. 123-220, R. 123-220-1, R. 123-221, R. 123-222, R. 123-222-1, R. 123-222-2, R. 123-223, R. 123-231, R. 123-232, R. 123-232-1, R. 123-233, R. 123-234, R. 123-234-1 et R. 123-234-2 sont applicables dans leur version résultant du décret n° 2022-1014 du 19 juillet 2022 ;

2° Le livre II, à l’exception des articles R. 229-1 à R. 229-26 et R. 252-1. L’article D. 223-2 est applicable dans sa rédaction en vigueur le lendemain de la publication du décret n° 2008-1419 du 19 décembre 2008. Les articles R. 223-20-1, R. 223-24, R. 225-98 et R. 227-1 sont applicables dans leur rédaction en vigueur le lendemain de la publication du décret n° 2009-234 du 25 février 2009 ;

3° Le livre III, à l’exception des articles R. 310-1 à R. 310-19, R. 321-1 à R. 321-73 ;

4° Le titre V du livre IV, à l’exception de l’article D. 450-3 ;

5° Le livre V, à l’exception des articles R. 522-1 à R. 522-25 ;

6° Le livre VI, à l’exception des articles R. 600-1, R. 600-2, R. 600-4 à R. 611-50, R. 621-1 à R. 663-40, R. 663-42 à R. 663-44, des deux premiers alinéas de l’article R. 663-45, des articles R. 663-47, R. 663-48 et R. 670-1 à R. 670-7 ;

7° Le titre II du livre VII dans sa rédaction issue du décret n° 2021-144 du 11 février 2021, à l’exception des articles R. 721-7 à R. 722-6, R. 722-8, R. 722-9, R. 722-11 à R. 722-17, R. 723-4, R. 723-9 à R. 723-31 ;

8° Le titre II du livre VIII, à l’exception des articles R. 822-149 à R. 822-162, dans sa rédaction en vigueur le lendemain de la publication du décret n° 2013-192 du 5 mars 2013. L’article R. 823-7-1 est applicable dans sa rédaction en vigueur le lendemain de la publication du décret n° 2009-234 du 25 février 2009.
