Article 11-1 of the French Code of Criminal Procedure

With the authorisation of the public prosecutor or examining magistrate, as the case may be, elements of ongoing legal proceedings may be communicated to authorities or bodies authorised for this purpose by order of the Minister of Justice, made where appropriate after consultation with the minister(s) concerned, to enable scientific or technical research or investigations to be carried out, intended in particular to prevent accidents from occurring, or to facilitate the compensation of victims or the payment of compensation for their loss. The agents of these authorities or bodies are then bound by professional secrecy with regard to this information, under the conditions and penalties of articles 226-13 and 226-14 of the Penal Code.

Article 11-1

Sur autorisation du procureur de la République ou du juge d’instruction selon les cas, peuvent être communiqués à des autorités ou organismes habilités à cette fin par arrêté du ministre de la justice, pris le cas échéant après avis du ou des ministres intéressés, des éléments des procédures judiciaires en cours permettant de réaliser des recherches ou enquêtes scientifiques ou techniques, destinées notamment à prévenir la commission d’accidents, ou de faciliter l’indemnisation des victimes ou la prise en charge de la réparation de leur préjudice. Les agents de ces autorités ou organismes sont alors tenus au secret professionnel en ce qui concerne ces informations, dans les conditions et sous les peines des articles 226-13 et 226-14 du code pénal.
