Article 1116 of the French Code of civil procedure

The requests referred to in the second paragraph of article 267 of the Civil Code are admissible only if the parties justify by any means their remaining disagreements. The notarial draft referred to in the fourth paragraph of article 267 of the Civil Code may be attached subsequently to the pleadings in which the application for liquidation and partition is made.

The joint declaration of acceptance provided for in the third paragraph of article 267 of the Civil Code shall be made in writing and signed by the two spouses and their respective lawyers. The points of disagreement mentioned in the declaration do not constitute claims within the meaning of article 4 of this code.

Les demandes visées au deuxième alinéa de l’article 267 du code civil ne sont recevables que si les parties justifient par tous moyens de leurs désaccords subsistants. Le projet notarié visé au quatrième alinéa de l’article 267 du code civil peut être annexé postérieurement aux conclusions dans lesquelles la demande de liquidation et de partage est formulée.

La déclaration commune d’acceptation prévue au troisième alinéa de l’article 267 du code civil est formulée par écrit et signée par les deux époux et leurs avocats respectifs. Les points de désaccord mentionnés dans la déclaration ne constituent pas des prétentions au sens de l’article 4 du présent code.
