Article 1133 of the French Civil Code

The essential qualities of the performance are those which have been expressly or tacitly agreed and in consideration of which the parties have contracted.

Error is a cause of nullity whether it relates to the performance of one party or the other.

Acceptance of a hazard as to a quality of the performance excludes error relating to that quality.

Les qualités essentielles de la prestation sont celles qui ont été expressément ou tacitement convenues et en considération desquelles les parties ont contracté.

L’erreur est une cause de nullité qu’elle porte sur la prestation de l’une ou de l’autre partie.

L’acceptation d’un aléa sur une qualité de la prestation exclut l’erreur relative à cette qualité.
