Article 1136-6 of the French Code of civil procedure

The parties defend themselves. They have the option of being assisted or represented by a lawyer.

The case is heard and argued in chambers, after advice from the public prosecutor.

The proceedings are oral.

The judge ensures that sufficient time has elapsed between the summons and the hearing for the defendant to have been able to prepare his defence.

The judge may, at any time during the proceedings, by simple mention in the file, order the personal appearance of a party, to hear him separately or in the presence of the other party.

During the hearing, the judge shall hear the parties. He will hear them separately if he so decides or if one of the parties so requests. This decision is simply noted in the file.

Les parties se défendent elles-mêmes. Elles ont la faculté de se faire assister ou représenter par un avocat.

L’affaire est instruite et débattue en chambre du conseil, après avis du ministère public.

La procédure est orale.

Le juge s’assure qu’il s’est écoulé un temps suffisant entre la convocation et l’audience pour que le défendeur ait pu préparer sa défense.

Le juge peut, à tout moment de la procédure, par simple mention au dossier, ordonner la comparution personnelle d’une partie, pour l’entendre séparément ou en présence de l’autre partie.

Lors de l’audience, le juge procède à l’audition des parties. Il les entend séparément s’il le décide ou si l’une des parties le sollicite. Cette décision fait l’objet d’une simple mention au dossier.
