As soon as notice is given that the proceedings have been initiated, the file may be consulted at the court registry, up until the day before the hearing or hearing, by the minor’s lawyer and that of his parents or one of their parents, his guardian, or the person or service to whom the child has been entrusted. The lawyer may obtain copies of all or part of the documents in the case file for the exclusive use of the educational assistance procedure. He may not transmit the copies thus obtained or the reproduction of these documents to his client.
The file may also be consulted, at their request and on the days and times set by the judge, by the parents, the guardian, the person or representative of the service to whom the child has been entrusted and by the minor capable of discernment, up to the day before the hearing or hearing.
The file concerning the minor who is capable of discernment may only be consulted in the presence of his or her parents or one of them or his or her lawyer. If the parents refuse and the person concerned does not have a lawyer, the judge will refer the matter to the President of the Bar with a request to appoint a lawyer to assist the minor or authorise the educational service in charge of the measure to accompany the minor for this consultation.
By reasoned decision, the judge may, in the absence of a lawyer, exclude all or part of the parts of the consultation by one or other of the parents, the guardian, the person or representative of the service to which the child has been entrusted or the minor when this consultation would pose a serious physical or moral danger to the minor, a party or a third party.
The file may also be consulted, under the same conditions, by the services in charge of the measures provided for in article 1183 of this code and to the articles 375-2 and 375-4 of the Civil Code.
On completion of the investigation, the file is forwarded to the public prosecutor, who returns it to the judge within fifteen days, accompanied by his written opinion on the action to be taken or an indication that he intends to formulate this opinion at the hearing.
