Avant toute audience, le dossier est transmis au procureur de la République qui fait connaître au juge, au moins huit jours avant l’audience, son avis écrit sur la suite à donner et lui indique s’il entend formuler cet avis à l’audience. Il n’y a pas lieu à communication pour avis avant la première audience lorsque le juge a été saisi par le ministère public.
