In addition to the reimbursement of their travel expenses, calculated in accordance with the conditions laid down for travel by civil servants for the Ministry of Justice, an allowance shall be paid to each person appointed as an ad hoc administrator, where they appear on the list provided for in article 53 of the Code of Criminal Procedure.
An indemnity for failure to act is allocated to the ad hoc administrator who has been unable to carry out his mission for a reason beyond his control, on the basis of a report indicating the diligence accomplished, under the conditions defined in article R. 53-8 of the Code of Criminal Procedure.
The amount of these allowances is set by joint order of the Keeper of the Seals, Minister of Justice, and the Minister responsible for the budget.
The costs of this compensation are recovered by the Treasury against the party ordered to pay costs, in accordance with the procedures and under the guarantees provided for criminal fines. In the absence of an order to pay costs, the costs are recovered against the party indicated by the judge who appointed the ad hoc administrator.
