Article 1238 of the French Code of civil procedure

The judge’s objection to the deliberation thus taken shall be made within fifteen days of its delivery or receipt, by order not subject to appeal.

Any member of the family council may also object to the deliberation within fifteen days of it, by application to the judge.

In all cases, the judge, by the same order, shall convene and convene within one month the family council, which he then chairs, for further deliberation on the same subject.

The articles 1234-1 to 1235 and 1239-3 are then applicable.

Article 1238

L’opposition du juge à la délibération ainsi prise est formée dans les quinze jours de la remise ou de la réception de celle-ci, par ordonnance non susceptible de recours.

Tout membre du conseil de famille peut également s’opposer à la délibération dans les quinze jours de celle-ci, par requête au juge.

Dans tous les cas, le juge, par la même ordonnance, convoque et réunit dans le délai d’un mois le conseil de famille dont il assure alors la présidence, afin qu’il soit à nouveau délibéré sur le même objet.

Les articles 1234-1 à 1235 et 1239-3 sont alors applicables.
