Article 1252 of the French Code of civil procedure

When the assets of an adult placed under court protection are in danger of being jeopardised, the public prosecutor or the guardianship judge may take any protective measures and, in particular, request or order the affixing of seals. In the event of difficulty, the judicial officer shall inform the guardianship judge or the public prosecutor.

The costs incurred by these measures are treated in the same way as the legal costs provided for in 3° of article R. 93 of the Code of Criminal Procedure.

Article 1252

Lorsque les biens d’un majeur placé sous sauvegarde de justice risquent d’être mis en péril, le procureur de la République ou le juge des tutelles peuvent prendre toutes mesures conservatoires et, notamment, requérir ou ordonner l’apposition des scellés. En cas de difficulté, l’huissier de justice en informe le juge des tutelles ou le procureur de la République.

Les frais occasionnés par ces mesures sont assimilés aux frais de justice prévus au 3° de l’article R. 93 du code de procédure pénale.
