Article 1292 of the French Code of civil procedure

The application for separation of property is brought before the family court of the family’s residence. It obeys the rules of Article 1136-1.

An extract of the application shall be forwarded by the applicant’s lawyer to the registries of the judicial courts within the jurisdiction of which both spouses were born, for the purpose of retention in the civil register and publication by mention in the margin of the birth certificate in accordance with the procedures laid down in Chapter III of Title I of this Book.

An extract of the application may, in addition, be published in a newspaper circulated within the jurisdiction of the court seised.

Article 1292

La demande en séparation de biens est portée devant le juge aux affaires familiales de la résidence de la famille. Elle obéit aux règles de l’article 1136-1.

Un extrait de la demande est transmis par l’avocat du demandeur aux greffes des tribunaux judiciaires dans le ressort desquels sont nés l’un et l’autre des époux, à fin de conservation au répertoire civil et de publicité par mention en marge de l’acte de naissance selon les modalités prévues au chapitre III du titre Ier du présent livre.

Un extrait de la demande peut, en outre, être publié dans un journal diffusé dans le ressort de la juridiction saisie.
