Article 131-6 of the French Code of civil procedure

The decision ordering mediation shall mention the agreement of the parties, appoint the mediator and the initial duration of the mediator’s assignment and indicate the date on which the case will be recalled to the hearing.

The decision sets the amount of the advance referred to in article 131-3 at a level as close as possible to the foreseeable remuneration, as well as the period of time within which the parties it appoints will make the payment directly to the mediator. If several parties are designated, the decision shall specify in what proportion each will make the payment.

If the advance is not paid in full within the prescribed period, the decision lapses and the proceedings continue.

Article 131-6

La décision qui ordonne une médiation mentionne l’accord des parties, désigne le médiateur et la durée initiale de sa mission et indique la date à laquelle l’affaire sera rappelée à l’audience.

La décision fixe le montant de la provision mentionnée à l’article 131-3 à un niveau aussi proche que possible de la rémunération prévisible, ainsi que le délai dans lequel les parties qu’elle désigne procéderont à son versement, directement entre les mains du médiateur. Si plusieurs parties sont désignées, la décision précise dans quelle proportion chacune effectuera le versement.

A défaut de versement intégral de la provision dans le délai prescrit, la décision est caduque et l’instance se poursuit.
