Article 131-8 of the French Code of civil procedure

The mediator does not have investigative powers. However, he may, with the agreement of the parties and for the purposes of the mediation, hear third parties who consent.

The mediator may not be appointed, during the same proceedings, to carry out an investigative measure.

Le médiateur ne dispose pas de pouvoirs d’instruction. Toutefois, il peut, avec l’accord des parties et pour les besoins de la médiation, entendre les tiers qui y consentent.

Le médiateur ne peut être commis, au cours de la même instance, pour effectuer une mesure d’instruction.
