Article 1315 of the French Code of civil procedure

The sealing report is signed and dated by the bailiff. It includes:

1° A reminder of the decision by virtue of which the bailiff is operating;

2° A summary account of the statements made by the persons present and the action, if any, taken on them;

3° A description of the premises and furnishings on which the seals have been affixed;

4° A summary description of the objects not placed under seal;

5° An indication of the measures taken to ensure the preservation of the premises and property and the safeguarding of domestic animals;

6° A mention of the formalities completed, if any, in application of the articles 1311 to 1314;

7° An indication of the surname, first name and capacity of the persons who attended the operations, who must sign the original ; in the event of refusal, this is stated in the deed;

8° Where applicable, the designation of the custodian established and a statement of his acceptance.

Article 1315

Le procès-verbal d’apposition des scellés est signé et daté par l’huissier de justice. Il comprend :

1° Le rappel de la décision en vertu de laquelle l’huissier de justice opère ;

2° Une relation sommaire des déclarations des personnes présentes et des suites qui, le cas échéant, leur ont été réservées ;

3° La désignation des lieux et des meubles meublants sur lesquels les scellés ont été apposés ;

4° Une description sommaire des objets qui ne sont pas mis sous scellés ;

5° L’indication des dispositions prises pour assurer la conservation des locaux et des biens et la sauvegarde des animaux domestiques ;

6° La mention des formalités accomplies, s’il y a lieu, en application des articles 1311 à 1314 ;

7° L’indication des nom, prénom et qualité des personnes qui ont assisté aux opérations, lesquelles doivent apposer leur signature sur l’original ; en cas de refus, il en est fait mention dans l’acte ;

8° Le cas échéant, la désignation du gardien établi et la mention de son acceptation.
