Article 1419 of the French Code of civil procedure

Before the judicial court in the matters referred to in Article 817, the protection litigation judge and the commercial court, the court shall declare the proceedings terminated if none of the parties appears.

Before the judicial court in other matters, the president shall declare the proceedings terminated if the creditor does not constitute a lawyer within the period provided for in article 1418.

The termination of the proceedings renders the order for an injunction to pay null and void.

Article 1419

Devant le tribunal judiciaire dans les matières visées à l’article 817, le juge des contentieux de la protection et le tribunal de commerce, la juridiction constate l’extinction de l’instance si aucune des parties ne comparaît.

Devant le tribunal judiciaire dans les autres matières, le président constate l’extinction de l’instance si le créancier ne constitue pas avocat dans le délai prévu à l’article 1418.

L’extinction de l’instance rend non avenue l’ordonnance portant injonction de payer.
