Article 1464 of the French Code of civil procedure

Unless the parties have agreed otherwise, the arbitral tribunal shall determine the arbitral procedure without being bound to follow the rules established for state courts.

However, the guiding principles of the proceedings set out in articles 4 to 10, the first paragraph of Article 11, the second and third paragraphs of Article 12 and to articles 13 to 21,23 and 23-1.

The parties and the arbitrators shall act expeditiously and fairly in the conduct of the proceedings.

Subject to legal obligations and unless the parties provide otherwise, the arbitral proceedings are subject to the principle of confidentiality.

Article 1464

A moins que les parties n’en soient convenues autrement, le tribunal arbitral détermine la procédure arbitrale sans être tenu de suivre les règles établies pour les tribunaux étatiques.

Toutefois, sont toujours applicables les principes directeurs du procès énoncés aux articles 4 à 10, au premier alinéa de l’article 11, aux deuxième et troisième alinéas de l’article 12 et aux articles 13 à 21,23 et 23-1.

Les parties et les arbitres agissent avec célérité et loyauté dans la conduite de la procédure.

Sous réserve des obligations légales et à moins que les parties n’en disposent autrement, la procédure arbitrale est soumise au principe de confidentialité.
