Article 147 of the French Code of Criminal Procedure

In all cases, release with or without judicial supervision may be ordered ex officio by the examining magistrate after receiving the opinion of the public prosecutor, on condition that the person under investigation undertakes to attend all the proceedings as soon as he or she is requested to do so and to keep the examining magistrate informed of all his or her movements.

The public prosecutor may also request release at any time. Unless he orders the person’s release, the investigating magistrate must, within five days of the public prosecutor’s request, forward the case file, together with his reasoned opinion, to the liberty and custody judge, who will rule within three working days.

En toute matière, la mise en liberté assortie ou non du contrôle judiciaire peut être ordonnée d’office par le juge d’instruction après avis du procureur de la République, à charge pour la personne mise en examen de prendre l’engagement de se représenter à tous les actes de la procédure aussitôt qu’elle en sera requise et de tenir informé le magistrat instructeur de tous ses déplacements.

Le procureur de la République peut également la requérir à tout moment. Sauf s’il ordonne la mise en liberté de la personne, le juge d’instruction doit, dans les cinq jours suivant les réquisitions du procureur de la République, transmettre le dossier, assorti de son avis motivé, au juge des libertés et de la détention, qui statue dans le délai de trois jours ouvrables.
