Article 148-7 of the French Code of Criminal Procedure

When the person under investigation, the accused or the defendant is detained, the application for release may also be made by means of a declaration to the head of the penitentiary establishment.

This declaration is recorded and dated by the head of the prison, who signs it, together with the applicant. If the latter is unable to sign, this is noted by the head of the establishment.

This document shall be sent without delay, in original or copy and by any means, either to the registrar of the court to which the case is referred, or to the registrar of the competent court according to the distinctions in Article 148-1.

Lorsque la personne mise en examen, le prévenu ou l’accusé est détenu, la demande de mise en liberté peut aussi être faite au moyen d’une déclaration auprès du chef de l’établissement pénitentiaire.

Cette déclaration est constatée et datée par le chef de l’établissement pénitentiaire qui la signe, ainsi que le demandeur. Si celui-ci ne peut signer, il en est fait mention par le chef de l’établissement.

Ce document est adressé sans délai, en original ou en copie et par tout moyen, soit au greffier de la juridiction saisie du dossier, soit à celui de la juridiction compétente selon les distinctions de l’article 148-1.
