Where, in the cases and in accordance with the procedures laid down by decree, the victim’s complaint is submitted electronically, the record of receipt of the complaint shall be drawn up in accordance with the procedures laid down in Article 801-1 and the receipt and, where applicable, a copy of the report may be sent to the victim as soon as possible, in accordance with the procedures laid down by decree.
The place of automated processing of nominative information relating to complaints sent in accordance with this article shall be deemed to be the place of the offence. The same applies to the processing of information relating to the reporting of offences.
Complaints by electronic means may not be imposed on the victim.
If justified by the nature or seriousness of the offence, the filing of a complaint by the victim in accordance with the procedures laid down in this article shall not exempt the investigators from interviewing the victim. The date of the interview may then be set when the complaint is lodged and the victim is informed of his or her rights as set out in article 10-2.
