Article 15-3 of the French Code of Criminal Procedure

Officers and agents of the judicial police are obliged to receive complaints lodged by victims of criminal offences, including when these complaints are lodged with a judicial police service or unit that is territorially incompetent. In this case, the complaint is, where appropriate, forwarded to the territorially competent service or unit.

All complaints filed are recorded in a report and a receipt is immediately issued to the victim, which mentions the time limits for public prosecution defined in articles 7 to 9 as well as the possibility of interrupting the limitation period by filing a complaint with civil party status, pursuant to article 85. Upon request, a copy of the report will be provided immediately. Officers or agents of the judicial police may identify themselves in the report by their administrative registration number.

Article 15-3

Les officiers et agents de police judiciaire sont tenus de recevoir les plaintes déposées par les victimes d’infractions à la loi pénale, y compris lorsque ces plaintes sont déposées dans un service ou une unité de police judiciaire territorialement incompétents. Dans ce cas, la plainte est, s’il y a lieu, transmise au service ou à l’unité territorialement compétents.

Tout dépôt de plainte fait l’objet d’un procès-verbal et donne lieu à la délivrance immédiate d’un récépissé à la victime, qui mentionne les délais de prescription de l’action publique définis aux articles 7 à 9 ainsi que la possibilité d’interrompre le délai de prescription par le dépôt d’une plainte avec constitution de partie civile, en application de l’article 85. Si elle en fait la demande, une copie du procès-verbal lui est immédiatement remise. Les officiers ou agents de police judiciaire peuvent s’identifier dans ce procès-verbal par leur numéro d’immatriculation administrative.
