Article 1555 of the French Code of civil procedure

The participatory procedure is extinguished by:

1° The expiry of the participatory procedure agreement;

2° The early termination of the agreement in writing by the parties assisted by their lawyers;

3° The conclusion of an agreement putting an end to the dispute or litigation in its entirety or the drawing up of a deed noting the persistence of all or part of the dispute or litigation;

4° Non-performance of the agreement by one of the parties;

5° Referral to the court, in the context of a participatory procedure for the purposes of preparing the case for trial, for the purpose of ruling on an incident, unless the referral is made by all the parties.

Article 1555

La procédure participative s’éteint par :


1° L’arrivée du terme de la convention de procédure participative ;


2° La résiliation anticipée et par écrit de cette convention par les parties assistées de leurs avocats ;


3° La conclusion d’un accord mettant fin en totalité au différend ou au litige ou l’établissement d’un acte constatant la persistance de tout ou partie de celui-ci ;


4° L’inexécution par l’une des parties, de la convention ;


5° La saisine du juge, dans le cadre d’une procédure participative aux fins de mise en état, aux fins de statuer sur un incident, sauf si la saisine émane de l’ensemble des parties.
