Article 173 quater of the French Customs Code

In the case of temporary admission for inward processing, the orders and decisions provided for in Article 169 above may authorise:

a) the offsetting of temporary admission accounts by products resulting from the use, by the tenderer, of goods of the same quality whose technical characteristics are identical to those of the goods imported under temporary admission ;

b) where circumstances warrant, the export of compensating products prior to the temporary importation of the goods to be processed by the exporter.

Article 173 quater

Dans le cas d’admission temporaire pour perfectionnement actif, les arrêtés et décisions prévus à l’article 169 ci-dessus peuvent autoriser :

a) la compensation des comptes d’admission temporaire par des produits provenant de la mise en oeuvre, par le soumissionnaire, de marchandises de même qualité dont les caractéristiques techniques sont identiques à celles des marchandises importées en admission temporaire ;

b) lorsque les circonstances le justifient, l’exportation des produits compensateurs préalablement à l’importation en admission temporaire des marchandises à transformer par l’exportateur.
