Article 174-1 of the French Code of Criminal Procedure

When the Investigating Chamber quashes an indictment for breach of the provisions of Article 80-1, the person is considered to be an assisted witness from the time of their first appearance and for all subsequent examinations, until the end of the investigation, subject to the provisions of articles 113-6 and 113-8.

Lorsque la chambre de l’instruction annule une mise en examen pour violation des dispositions de l’article 80-1, la personne est considérée comme témoin assisté à compter de son interrogatoire de première comparution et pour l’ensemble de ses interrogatoires ultérieurs, jusqu’à l’issue de l’information, sous réserve des dispositions des articles 113-6 et 113-8.
