Article 189 of the French Code of civil procedure

The parties shall be questioned in each other’s presence unless circumstances require them to be questioned separately. They must be confronted if one of the parties so requests.

Where the appearance of only one of the parties has been ordered, that party shall be questioned in the presence of the other unless the circumstances require that it be questioned immediately or out of his presence, subject to the right of the absent party to have immediate knowledge of the statements of the party heard.

The absence of one party shall not prevent the other from being heard.

Les parties sont interrogées en présence l’une de l’autre à moins que les circonstances n’exigent qu’elles le soient séparément. Elles doivent être confrontées si l’une des parties le demande.

Lorsque la comparution d’une seule des parties a été ordonnée, cette partie est interrogée en présence de l’autre à moins que les circonstances n’exigent qu’elle le soit immédiatement ou hors sa présence, sous réserve du droit pour la partie absente d’avoir immédiatement connaissance des déclarations de la partie entendue.

L’absence d’une partie n’empêche pas d’entendre l’autre.
