Article 196 of the French Code of Criminal Procedure

The Public Prosecutor acts in the same way when he receives, subsequent to a decision by the Investigating Chamber to dismiss the case, documents which appear to him to contain new charges under the terms of article 189. In such a case and pending a meeting of the Investigating Chamber, the President of that court may, on the application of the Public Prosecutor, issue a committal or arrest warrant.

Le procureur général agit de même lorsqu’il reçoit, postérieurement à un arrêt de non-lieu prononcé par la chambre de l’instruction, des pièces lui paraissant contenir des charges nouvelles dans les termes de l’article 189. Dans ce cas et en attendant la réunion de la chambre de l’instruction, le président de cette juridiction peut, sur les réquisitions du procureur général, décerner mandat de dépôt ou d’arrêt.
