Article 196 ter of the French Customs Code

1. Travellers who are going to stay temporarily outside the customs territory may temporarily export free of exit duties and taxes the articles they take with them which are exclusively for their personal use.

Items prohibited from export are excluded from this measure.

2. The procedures for applying this article are laid down by orders of the Minister for the Economy and Finance, who may, in particular, make export subject to the subscription of acquits-à-caution, derogate from the provisions of 1 above relating to articles prohibited from being exported insofar as these are not prohibitions introduced in the interests of public order and determine the conditions under which the said articles may be re-imported free of duty and in derogation from import prohibitions.

1. Les voyageurs qui vont séjourner temporairement hors du territoire douanier peuvent exporter en franchise temporaire des droits et taxes de sortie les objets exclusivement destinés à leur usage personnel qu’ils emportent avec eux.

Sont exclus de cette mesure les objets prohibés à l’exportation.

2. Les modalités d’application du présent article sont fixées par des arrêtés du ministre de l’économie et des finances qui peuvent notamment subordonner l’exportation à la souscription d’acquits-à-caution, déroger aux dispositions du 1 précédent visant les objets prohibés à l’exportation dans la mesure où il ne s’agit pas de prohibitions instituées dans un intérêt d’ordre public et déterminer les conditions de réimportation desdits objets en franchise et en dérogation aux prohibitions d’importation.
