Article 2-16 of the French Code of Criminal Procedure

Any association that has been duly registered for at least five years on the date of the events and that proposes, through its articles of association, to combat drug addiction or drug trafficking may exercise the rights granted to civil parties in respect of the offences provided for in the articles 222-34 to 222-40 and by article 227-18-1 of the Penal Code when the public prosecution has been initiated by the public prosecutor or the injured party.

Any foundation recognised as being in the public interest may exercise the rights recognised to a civil party under the same conditions and subject to the same reservations as the association mentioned in this article.

Article 2-16

Toute association régulièrement déclarée depuis au moins cinq ans à la date des faits qui se propose, par ses statuts, de lutter contre la toxicomanie ou le trafic de stupéfiants peut exercer les droits reconnus à la partie civile en ce qui concerne les infractions prévues par les articles 222-34 à 222-40 et par l’article 227-18-1 du code pénal lorsque l’action publique a été mise en mouvement par le ministère public ou la partie lésée.

Toute fondation reconnue d’utilité publique peut exercer les droits reconnus à la partie civile dans les mêmes conditions et sous les mêmes réserves que l’association mentionnée au présent article.
