Article 212-5 of the French Cinema and Moving Image Code

The authors must have previously collaborated on the production of at least one feature film, documentary or animated film that meets the following conditions:
1° It must have been released in cinemas in France during the year preceding the application;
2° It must have been produced under production conditions that enabled production approval to be granted or distribution approval to be granted;
3° It must have had a final production cost of less than :

– 500,000 for documentaries;
– €4,000,000 for fiction;
– €7,000,000 for animation.

In this context, the authors must have signed a copyright assignment contract that includes a remuneration proportional to the revenue from the sale or exploitation of the work.
The same cinematographic work may not be taken into account for the eligibility of more than three authors for the purposes of aid applications relating to the development of separate projects.

Article 212-5

Les auteurs doivent avoir précédemment collaboré à la réalisation d’au moins une œuvre cinématographique de fiction, de documentaire ou d’animation répondant aux conditions suivantes :
1° Etre sortie en salles de spectacles cinématographiques en France au cours de l’année précédant la demande ;
2° Avoir été produite dans des conditions de production permettant la délivrance de l’agrément de production ou avoir donné lieu à la délivrance de l’agrément de distribution ;
3° Avoir un coût définitif de production inférieur à :

– 500 000 € lorsqu’elle appartient au genre documentaire ;
– 4 000 000 € lorsqu’elle appartient au genre fiction ;
– 7 000 000 € lorsqu’elle appartient au genre animation.

Dans ce cadre, les auteurs doivent avoir conclu un contrat de cession de droits d’auteurs comportant à leur profit une rémunération proportionnelle aux recettes provenant de la vente ou de l’exploitation de l’œuvre.
Une même œuvre cinématographique ne peut pas être prise en compte pour l’éligibilité de plus de trois auteurs au titre de demandes d’aides portant sur la conception de projets distincts.
