Article 213 of the French Code of Criminal Procedure

If the Investigating Chamber considers that the facts constitute a misdemeanour or a contravention, it orders the case to be referred to the Criminal Court, in the first case, and to the Police Court, in the second case. Article 184 shall apply.

The detained defendant is immediately released and the judicial supervision order is terminated. However, the Investigating Chamber may apply, in a specially reasoned judgment, the provisions set out in the third and fourth paragraphs of Article 179.

In the event of referral to the police court, the detained accused is immediately released; judicial supervision ends.

Article 213

Si la chambre de l’instruction estime que les faits constituent un délit ou une contravention, elle prononce le renvoi de l’affaire, dans le premier cas devant le tribunal correctionnel, dans le second cas devant le tribunal de police. L’article 184 est applicable.

Le prévenu détenu est immédiatement remis en liberté et le contrôle judiciaire prend fin. Toutefois, la chambre de l’instruction peut faire application, par un arrêt spécialement motivé, des dispositions prévues aux troisième et quatrième alinéas de l’article 179.

En cas de renvoi devant le tribunal de police, le prévenu détenu est immédiatement remis en liberté ; le contrôle judiciaire prend fin.
