Article 2222 of the French Civil Code

A statute that extends the duration of a prescription or foreclosure period has no effect on an existing prescription or foreclosure period. It applies where the prescription period or the foreclosure period had not expired on the date of its entry into force. In this case, account is taken of the period that has already elapsed.

In the event of a reduction in the duration of the prescription period or the period of foreclosure, this new period runs from the day on which the new law comes into force, without the total duration exceeding the period provided for by the previous law.

Article 2222

La loi qui allonge la durée d’une prescription ou d’un délai de forclusion est sans effet sur une prescription ou une forclusion acquise. Elle s’applique lorsque le délai de prescription ou le délai de forclusion n’était pas expiré à la date de son entrée en vigueur. Il est alors tenu compte du délai déjà écoulé.

En cas de réduction de la durée du délai de prescription ou du délai de forclusion, ce nouveau délai court à compter du jour de l’entrée en vigueur de la loi nouvelle, sans que la durée totale puisse excéder la durée prévue par la loi antérieure.
