Article 230-18 of the French Code of Criminal Procedure

In application of Article 31 of the aforementioned Law No. 78-17 of 6 January 1978, a decree in the Council of State, issued after consultation with the National Commission for Information Technology and Civil Liberties, shall set the terms and conditions for the application of this section. It shall specify how long the recorded data is to be kept, the procedures for authorising the persons mentioned in 1° and 3° of Article 230-16 as well as, where applicable, the conditions under which interested parties may exercise their right of access and challenge decisions taken by the public prosecutor or magistrate referred to in Article 230-9.

Article 230-18

En application de l’article 31 de la loi n° 78-17 du 6 janvier 1978 précitée, un décret en Conseil d’Etat, pris après avis de la Commission nationale de l’informatique et des libertés, fixe les modalités d’application de la présente section. Il précise la durée de conservation des données enregistrées, les modalités d’habilitation des personnes mentionnées aux 1° et 3° de l’article 230-16 ainsi que, le cas échéant, les conditions dans lesquelles les personnes intéressées peuvent exercer leur droit d’accès et contester les décisions prises par le procureur de la République ou le magistrat mentionné à l’article 230-9.
