Article 231-18 of the French Cinema and Moving Image Code

The application of the reduction coefficient is based on the conditions of reception and comfort in the cinema or cinemas, the diversity of art house films programmed, the number of weeks and screenings, excluding the period of works, during which these works are shown, local conditions and the cultural environment of the cinema, its economic situation, and the presentation of the application.
This assessment is based in particular on the following criteria:
1° The number of cinema weeks of operation of the establishments during the reference period, in accordance with the table in the appendix to this book, except for new establishments;
2° The number of film screenings per cinema, in accordance with the table in the appendix to this book, except for new establishments;
3° The number and diversity of art house films programmed, in accordance with the table in the appendix to this book;
4° The comfort of the cinemas and the technical quality of the screenings, in accordance with the table in the appendix to this book;
5° The quality of the information provided;
6° The economic situation of the cinema;
7° The absence or weakness of promotional activities;
8° The local conditions and cultural environment in which the exhibitor operates, as well as the particular efforts made by the exhibitor in the field of distribution.
For the application of the reduction coefficients mentioned in 2°, 5°, 6°, 7° and 8°, the arthouse cinema commission decides by a two-thirds majority.

Article 231-18

L’application du coefficient minorateur est effectuée au regard des conditions d’accueil et de confort dans la ou les salles de l’établissement, de la diversité des œuvres cinématographiques d’art et d’essai programmées, du nombre de semaines et de séances, hors période de travaux, durant lesquelles sont représentées ces œuvres, des conditions locales et de l’environnement culturel de l’établissement, de sa situation économique, ainsi que de la présentation de la demande.
Cette appréciation se fonde notamment sur les critères suivants :
1° Le nombre de semaines cinématographiques de fonctionnement des établissements au cours de la période de référence, conformément à la grille figurant en annexe du présent livre, sauf pour les nouveaux établissements ;
2° Le nombre de séances de spectacles cinématographiques par salle, conformément à la grille figurant en annexe du présent livre, sauf pour les nouveaux établissements ;
3° Le nombre et la diversité des œuvres cinématographiques d’art et d’essai programmées, conformément à la grille figurant en annexe du présent livre ;
4° Le confort des salles et la qualité technique de la projection, conformément à la grille figurant en annexe du présent livre ;
5° La qualité des informations fournies ;
6° La situation économique de l’établissement de spectacles cinématographiques ;
7° L’absence ou la faiblesse des actions d’animation ;
8° Les conditions locales et l’environnement culturel dans lesquels l’exploitant exerce son activité, ainsi que l’effort particulier accompli par l’exploitant dans le domaine de la diffusion.
Pour l’application des coefficients minorateurs mentionnés aux 2°, 5°, 6°, 7° et 8°, la commission du cinéma d’art et d’essai se prononce à la majorité des deux tiers.
